Standard Terms & Conditions

Below are SIMBA’s Standard Terms and Conditions, which apply to all contracts with our consumer customers, and any other contracts that make reference to these Standard Terms and Conditions.

Please read the Critical Information Summary (CIS) of your mobile plan too, as it also includes terms and conditions that apply to your mobile plan, and sets out the important information you need to know about SIMBA services. You can download a copy of the CIS in PDF (Click here.)

Base Plan
  1. The base plan of every SIMBA Mobile Plan consists of:
    1. Free Incoming Calls
    2. Free Incoming SMS
    3. Free Caller Number Display
Promotional Bonus for Mobile Plans
  1. This promotion is valid for all new and existing SIMBA mobile plans (Postpaid, Prepaid, Business) customers unless stated otherwise. Existing customers will enjoy the promotion bonus upon renewal of the plans.
  2. This promotion will be valid until a date determined exclusively by SIMBA, without further notice to the Customer.
  3. The details of the Promotional Bonus are as follow
    1. All SIMBA mobile plans for consumers come with Main Data that can be used in Singapore, Malaysia, Hong Kong, Indonesia and Thailand; Global (60+ Countries) Data that can be used in Group A countries and APAC (7 Countries) can be used in Taiwan, Bangladesh, Vietnam, China, South Korea, Australia and New Zealand. APAC (15 Countries) roaming to Taiwan, Bangladesh, Vietnam, China, South Korea, Australia, New Zealand, Japan, Cambodia, Myanmar, Philippines, Macau, Brunei, India and Laos are included in selected plans too.       *IDD + SG mins is a shared allowance of minutes that can be used for both international direct dialling (IDD) and local fixed line outgoing calls, without charge.​


      1. Free Voice Roaming shall mean that SIMBA will waive any charges for VoLTE calls made or received by a SIMBA subscriber while they are outside of Singapore and/or using their SIMBA mobile plan on a roaming basis in a country or jurisdiction where SIMBA's preferred roaming partner has enabled VoLTE interconnection, subject always to the minutes limit of the relevant mobile plan. The SIMBA subscriber's mobile device must be VoLTE enabled.

  4. Promotional Bonus, and promotions conducted by SIMBA, cannot be exchanged for cash and other items, and are not valid with any other discounts, vouchers or promotions, unless otherwise stated. Any unutilised quota will not be refunded and cannot be used to offset other promotions.
  5. All SIMBA’s Standard Terms & Conditions, Fair Use Policy, and relevant Critical Information Summary shall be applicable, a copy of which can be referred to at https://simba.sg/terms.
  6. In the event of any conflict or inconsistency between the terms, such conflict or inconsistency shall, in the absence of any express agreement to the contrary, be resolved in a manner most favourable to SIMBA, to the fullest extent permissible under applicable laws. SIMBA reserves the right to vary any term or condition. SIMBA will, where it is practicable and/or required to do so, give the Customer advance notice of such changes.
The RoamFree 500 Pack
  1. The RoamFree 500 Pack is a promotion that can be inserted into existing subscriptions of SIMBA mobile plans (Postpaid, Prepaid, Business and Data-only), subject always to the conditions stated below.
  2. To be entitled to the insertion of the RoamFree 500 Pack, the Subscriber must:
    1. have an active SIMBA mobile plan;
    2. top up exactly $16 into their SIMBA wallet during the indicated promotional period using the applicable top up method for which the RoamFree 500 Pack is made available; and
    3. indicate during the top up that they wish to insert the RoamFree 500 Pack into the SIMBA mobile plan.
  3. The RoamFree 500 Pack is provided to the Subscriber on a complimentary basis, and strictly does not form any part of the consideration for the Subscriber’s top up. The consideration for the Subscriber’s top up is the SIMBA credits that are credited into the relevant SIMBA wallet upon the successful top up.
  4. SIMBA reserves the right to amend and/or withdraw this promotion and these terms and conditions applicable to this promotion at any time at its sole discretion without prior notice, and the Subscriber acknowledges and agrees that they shall waive any recourse against SIMBA arising from or in connection with such amendment and/or withdrawal, including but not limited to any claim for compensation, damages, or loss of anticipated benefits under the promotion due to, in part or in whole, the complimentary nature of this promotion, which is offered as a gratuitous benefit and not as a contractual entitlement.
  5. The RoamFree 500 Pack consists of a pool of 500GB of mobile roaming data that is usable only in Japan, People’s Republic of China, and South Korea, for a term of 360 days commencing on the day the Subscriber topped up $16, and expiring at 2359 hours of the 360th day of the effective term of inserted RoamFree 500 Pack, unless the RoamFree 500 Pack is terminated at an earlier time by SIMBA at its sole discretion or in accordance with these terms.
  6. The Subscriber acknowledges that the RoamFree 500 Pack, once inserted, continues to be provided by SIMBA on a complimentary basis. Without prejudice to SIMBA’s rights under Clause 4, SIMBA may terminate an already-inserted RoamFree 500 Pack prior to the expiry of its term without prior notice. Any such termination shall be without liability to SIMBA, and the Subscriber shall have no claim for compensation, damages, or loss of anticipated benefits arising from such termination.
  7. The benefits of the RoamFree 500 Pack are non-stackable, and the RoamFree 500 Pack is non-transferable, non-refundable, and cannot be exchanged for cash or cash-in-kind. If a Subscriber chooses for a RoamFree 500 Pack to be inserted into their SIMBA mobile plan during the effective term of a previously inserted RoamFree 500 Pack, the previously inserted RoamFree 500 Pack shall be terminated immediately upon the insertion of the new RoamFree 500 Pack. The term and the mobile roaming data in the pool shall be refreshed upon successful insertion.
  8. The Subscriber’s mobile roaming data shall be utilised in the following manner of precedence:
    1. The mobile roaming data in the RoamFree 500 Pack shall be utilised first;
    2. Upon exhaustion of the mobile roaming data in the RoamFree 500 Pack, the mobile roaming data in APAC shall be utilised second;
  9. The Subscriber cannot, without SIMBA’s written consent, terminate the inserted RoamFree 500 Pack. However, the RoamFree 500 Pack shall be terminated if the Subscriber’s SIMBA mobile plan is terminated in accordance with the applicable SIMBA contractual provisions or prevailing regulations. For avoidance of doubt, pursuant to SIMBA’s Standard Terms & Conditions, a successful change of plan will result in the termination of the Subscriber’s previous SIMBA mobile plan, and shall result in the termination of the RoamFree 500 Pack for the purpose this paragraph. If the Subscriber’s SIMBA mobile plan is suspended in accordance with the applicable SIMBA contractual provisions or prevailing regulations, the term of the RoamFree 500 Pack shall not lapse, but the Subscriber will not be able to use the mobile roaming data until the suspension of their SIMBA mobile plan is lifted.
  10. Upon expiry of the term of the RoamFree 500 Pack, any unutilised mobile roaming data will not be refunded.
  11. Usage of this promotion and the mobile roaming data shall always be subject to all SIMBA's Standard Terms & Conditions, Fair Use Policy, and relevant Critical Information Summary.
  1. The Agreement
    1. An agreement is formed when you apply to subscribe to a mobile plan offered by us and we accept your application. Your application and our acceptance may be made over the phone, or by completing an online ordering process or a physical order form. You are deemed to have reviewed these Terms and Conditions, and are agreeable to the contents herein, upon the formation of the agreement.
    2. You are a minor if you are less than 18 years old. As a minor, in accordance with IMDA’s regulations, you are eligible to subscribe to our services under your name if you are at least 16 years of age.
    3. The agreement will be made up of:
      1. These Standard Terms and Conditions;
      2. The terms and conditions in the CIS; and
      3. The plan brochure or other document provided to you relating to the service.
    4. If there is inconsistency between any part of the agreement, the inconsistency will be resolved according to the following order of priority:
      1. These Standard Terms and Conditions;
      2. The terms and conditions in the CIS; and
      3. The plan brochure or other document provided to you relating to the service.
  2. Period of the Agreement
    1. The agreement commences when your application is accepted by us, unless otherwise specifically stated in the agreement.
    2. For contracts other than fixed period contracts, the agreement will continue until it is terminated by either party in accordance with the agreement.
    3. For fixed period contracts, the agreement will continue:
      1. for the minimum contract period referred to in your application, in the CIS or plan brochure; or
      2. until it is terminated in accordance with clause 13.
    4. If neither you nor SIMBA terminates the agreement at the end of the fixed period contract, the service shall roll over on a “billing period”-to-“billing period” basis on the same terms and conditions. For avoidance of doubt, in the event that the mobile plan is upgraded by SIMBA, the rolling over of the service to another “billing period” does not automatically entitle you to the upgraded service.
  3. Changes to the Agreement
    1. To the extent permitted under applicable laws, we may change, amend, vary or supplement any terms and conditions of the agreement (including these Standard Terms and Conditions). We will give you notice of such changes, by email, with or as part of a bill, by mail, advertisement, statements, letters, postings on our website at www.simba.sg or such other forms as we deem appropriate. You will be deemed to accept the changes if you continue to use the service. As the changes will apply to your agreement with us, you are encouraged to check our website regularly. This clause confirms our compliance to IMDA’s restriction against detrimental or disadvantageous mid-contract changes to fixed term service contract.
    2. We may withdraw any plans/packages at any time by giving you notice but such withdrawals will only take effect from the end of your then current fixed-period contract.
    3. We reserve the right to change the roaming destination countries and roaming charges from time to time. All changes will be published on our website at www.simba.sg You agree that such publication is sufficient notice to you of such changes; and such change is not detrimental or disadvantageous to you. You will be deemed to accept the changes if you continue to use the service. You are encouraged to check our website regularly for updates of such changes.
  4. Applications
    1. You warrant that information provided to us in the application is true and correct in all material respects and you acknowledge that we will rely on it. You agree that, if you give us incorrect information during an application which is then relied upon and used by a third party carrier for the provision or attempted provision of a service, you will be liable for a resubmission of application payment to us.
    2. An application for Service may be refused by us in the following circumstances:
      1. Where there is a technical limitation to our ability to provide you the service, including where there are network capacity constraints;
      2. Where you have not completed an application process correctly or have been unwilling to provide us with a document or information we require;
      3. Where you do not meet our credit assessment criteria.
    3. By applying for a service, you authorise us to communicate with credit referencing bodies/associations about your credit history and in so doing to provide them with the details that you have provided to us and to collect your personal data from such bodies/associations. We may do this from time to time during the term of the agreement.
    4. We may apply restrictions to a service where you have not met our credit assessment criteria. We will advise you of the general nature of the reasons for these restrictions and, if applicable, how you may access services which have been restricted.
  5. Third Party Service Providers:
    1. SIMBA does not endorse the provision of registration services by unauthorised third-party service providers.
    2. SIMBA shall not be liable for any loss you may suffer or incur be it indirect, special, incidental or consequential damages arising from and/or in connection with your use such unauthorised third-party service providers.
    3. SIMBA reserves the right not to accept your application if made under such registrations.
  6. Your Personal Data 
    1. As part of your application and in connection with the provision of services to you, we may collect from your personal data and other matters for use and disclosure subject to the terms and condition in our Data Protection Notice as set out at www.simba.sg/data-protection-notice, and the Personal Data Protection Act 2012 (PDPA), which may be amended from time to time. SIMBA is required by law to collect and retain certain personal data about you, your NRIC, FIN or passport number, name, address and telephone service number, email address, date of birth including your account information and any other information required by the Infocom Media Development Authority (IMDA), which may be also amended from time to time.
    2. Your use of our services, website(s) and/or SIMBA SG App is subject to our Data Protection Notice as set out at www.simba.sg/data-protection-notice.
  7. Minimum Contract Period
    1. The Minimum Contract Period is the minimum fixed period of the agreement. The Minimum Contract Period will be specified in the agreement. The Minimum Contract Period commences when the service is activated, unless otherwise specified in the agreement.
    2. If, during the Minimum Contract Period, you cancel the service or we cancel the service because of your default, you may be liable to pay an early termination charge which set out in the agreement.
    3. Once the Minimum Contract Period is over, your service will continue to renew automatically on the same terms and conditions, unless otherwise specified in the agreement, and you will continue to be charged for the service, until the expiry of the then current contract period.
  8. Usage
    1. You acknowledge that charges may be incurred when the service under your mobile plan are used. It is therefore important that you take steps to ensure that such usage does not occur without your authorisation. You should ensure that you are in control of your login names, passwords, SIM card, devices that make use of the service, such as computers, handsets, mobile phones, and wireless devices connected to the service and that third parties cannot access or use such equipment without your authority. You acknowledge that usage of some services can occur because of an infection of your computer with a virus or due to other unauthorised third-party intrusions. You should ensure that you have appropriate protection systems operating on your equipment to restrict or limit the possibility of unauthorised usage.
    2. You will ensure that:
      1. Any device that you use will be suitable for your intended use of the service that we provide to you, including but not limited to being able to support VoLTE for voice calls;
      2. As we are not able to control access or usage of your handsets and other equipment, you are responsible for all usage charges in respect of the use of the services, whether or not such usage was authorised by you, unless the usage was caused by a mistake by us.
    3. You acknowledge that we cannot be held responsible for any loss incurred by you because of faults and/or failures within a third-party carrier's network infrastructure.
    4. SIMBA’s 5G is available to all subscribers free-of-charge as a pilot launch of the service. The pilot launch of SIMBA’s 5G is a trial service to provide benefit to you while we continue to expand our 5G coverage around Singapore, and this will be available to you as long as you are using SIMBA’s Services on a 5G NSA-enabled device. SIMBA’s 5G is provided on a best-efforts basis during this pilot launch, and makes no warranty with regard to the performance of the 5G trial service used by you. You agree and acknowledge that your subscription to SIMBA’s Services is for SIMBA’s 4G services only, until further notice of the launch of SIMBA’s commercial 5G services.
    5. Even if you lose your equipment or permit another person to use the service, you are solely responsible for its use including:
      1. the calls made, messages sent and data used;
      2. the sites and content accessed;
      3. the content or software downloaded and the effect it may have on your equipment or service;
      4. the products and services purchased;
      5. the information provided to others;
      6. the installation or use of any equipment or software whether provided by us or not;
      7. the modification of any settings or data on your service or related services or equipment whether instructed by us or not;
      8. the personal supervision of any users under the age of 16 who use the service; and
      9. the lawfulness of your activities when using the service and accessing any sites and third-party content.
    6. The service is provided to you on the basis that it is used only for approved purposes. In particular you must:
      1. not use the service in any manner involving illegal, malicious, deceptive or misleading activity;
      2. not breach any standards, content requirements or codes set out by any relevant authority or industry body;
      3. not use the service in any way which interferes with the operations of the service network, anyone else's enjoyment of their service or which upsets or offends any person;
      4. not use the service for commercial purposes or in any way distribute or resell the service without our written permission;
      5. obey all laws, regulations, guidelines and our reasonable instructions concerning your use of the service;
      6. give us all information and cooperation that we may need in relation to the service; and
      7. advise us of changes in your personal data such as account details, debit or credit card details and expiry dates and billing addresses.
      8. Not use the service for the registration with any financial institution where it is reasonably foreseeable that such financial institution will communicate with you through your usage of the service.
    7. You must not use the service in a way which:
      1. contravenes any fair use policy or acceptable use policy that is applicable to the service; or
      2. you know or ought to know would contravene any reasonable fair use policy that may be applicable to the service.
    8. You agree that you can only change your mobile plan with SIMBA’s approval at our absolute discretion, and if your mobile plan is not suspended, blacklisted or has an outstanding balance. SIMBA shall not be required to provide any explanation for our decision to reject your request to change your mobile plan. If your requested to change your mobile plan is approved, your subscription to the new mobile plan will be deemed to be a new subscription, any clauses in these Terms and Conditions that are applicable to new subscriptions will apply.
    9. You must not use the service directly or indirectly in activities that are detrimental to our internet service or jeopardise the use of our service or its performance for other customers or how the wider community will perceive SIMBA. Such activities include, but are not limited to:  
      1.  'Spamming' e-mail/messages or forwarding spammed e-mail/messages to others;
      2. being listed or causing the listing of us or our other customers on any real-time blacklist (eg causing the MSISDN assigned as part of the service to be blacklisted by other service providers);
      3. e-mail bombing and the use of bulk e-mail programs to unsolicited recipients making commercial advertising, informational announcements, charity requests, petitions for signatures, chain letters and political or religious messages;
      4. attempting to obtain unauthorised access to other Internet servers and systems; and
      5. making misrepresentations or abusive or offensive behaviour in newsgroups and other online facilities; the service has been used for inappropriate purposes, eg to post to or transmit to any material which interferes with other users or defames, harasses, threatens, menaces, offends or restricts any person or which inhibits any other customer from using or enjoying the service provided to them. What constitutes inappropriate use will be determined by us, at our sole discretion provided that we act reasonably. You must not use the service to send unsolicited electronic mail messages to anyone. You must not attempt any of these acts or permit another person to do any of these acts;
    10. You shall not use the service for offensive and/or illegal activities under any applicable laws in Singapore. This includes the dissemination of pornographic material and other illegal content. In such cases, the relevant law enforcement agency(ies) will be notified, and offending material(s) may be passed on to them.
    11. We may (but shall not be obligated to) monitor your use of the service. If we identify excessive use or unusual activity that has created or is likely to create imminent physical harm (eg interruption, disruption or congestion) to our network, we may temporarily restrict or suspend your service. If we do so we will endeavour to contact you via your nominated primary contact details. We may require an advance payment before your service is restored. You should not rely on us to contact you or to suspend your service in the event of excessive or unusual activity.
    12. We may investigate any misuse of the service by you, in conjunction with relevant law enforcement agencies. If your use of the service or breach of any provision in these Standard Terms and Conditions results in loss to other users or us, you may be liable to pay compensation.
    13. As part of your subscription to SIMBA’s services, you are given the option to not receive international incoming calls and/or SMS, and shall be required to indicate whether you want to opt in or opt to this option.
      1. By opting into this option, you explicitly agree and acknowledge that SIMBA will, to the best of its efforts, block all international incoming calls and/or SMS to your mobile number without exceptions. In doing so, you release SIMBA from any liability in the event that you miss or do not receive any international incoming calls and/or SMSes, be it from a business you have dealings with, your family members abroad, or emergency calls and/or SMSes. Furthermore, you release SIMBA from any liability arising from international incoming calls and/or SMSes that you may receive after opting into this option.
      2. If you choose not to opt into this option or decide to opt out, you acknowledge that SIMBA will not block international incoming calls and/or SMSes to your mobile number. This means you will continue to receive international calls and/or SMSes, including potential scam calls and/or SMSes.
      3. You agree and acknowledge that any changes in your decision to opt in or out of this option will only take effect within 24 hours. During this interim period, you release SIMBA from any liability should you encounter difficulties receiving or are unable to receive international calls and/or SMSes, as the case may be. You hereby waive all claims against SIMBA for any damages, losses, or expenses resulting from or consequential of your prior election.
      4. Any decision to opt in or out of this option is presumed to be made by you with full consent and agreement. You agree to absolve SIMBA of any liability arising from any election into or out of the option using your mobile number without your explicit consent and/or knowledge.
      5. You acknowledge that information and/or data concerning the international incoming calls and/or SMSes blocked from your mobile number will only be available to you for a fee of $100 per retrieval per calendar month, provided on a best-efforts basis.
      6. You agree and acknowledge that any inquiries or questions regarding this option should be directed to IMDA at info@imda.gov.sg.
    14. You acknowledge that SIMBA does not owe any user of the service any duty of care(contractual, tortious, at equity, or otherwise) to protect that user from scams arising from their use of the service, and that the user will, in their use of the service, act with sufficient caution and prudence that is expected of a reasonable person. To the maximum extent permitted by the applicable laws, you waive any and all claims, liabilities and causes of action, whether known or unknown, against SIMBA arising out of or in relation to any losses that you have suffered because of a scam that was communicated to you in your use of the service. This waiver includes, but is not limited to, claims for indirect, incidental, or consequential damages, even if such damages were foreseeable.
    15. If you do make a claim, commence an action, or in any way hold SIMBA liable for any losses that you have suffered because of a scam that was communicated to you in your use of the service, you will indemnify SIMBA for all of its losses and expenses (including legal expenses and regulatory penalties) in relation to or arising from SIMBA’s defending of such a claim, action, or otherwise. You agree and acknowledge that your agreement to clauses 8.6(h) and 8.14 above shall constitute sufficient reason, to the extent legally permitted, to absolve SIMBA of any liability to you for any losses you may suffer from any scam that was communicated to you in your use of the service, and will suffice to show that your claim, action or otherwise discloses no reasonable cause of action and/or is scandalous, frivolous or vexatious and/or is otherwise an abuse of the process of the court.
    16. Each registrant for mobile business plans can only activate thirty (30) mobile business plans per calendar day. In completing the registration for a mobile business plan, the registrant expressly agrees to this restriction and waives their right to make any claim against SIMBA for any direct or indirect losses arising from this restriction on collection, and further acknowledges and accepts that all monies paid are not refundable regardless and in spite of this restriction on collection.
    17. All SIMBA mobile plans are intended for general mobile data use primarily in Singapore and are not designed for
      1. continuous or sustained constant bit rate (CBR) traffic, including (but not limited to) uninterrupted video streaming, persistent telemetry, machine-to-machine connections, or any application that maintains an always-on, non-variable data flow; or
      2. continuous or sustained use of roaming mobile data (i.e., mobile data usage outside of Singapore on a non-SIMBA mobile network) for a period exceeding thirty (30) consecutive days without the SIM returning to Singapore and connecting to SIMBA’s home mobile network.
      To ensure a fair and non-discriminatory experience for all end-users, and consistent with IMDA’s requirements on reasonable traffic management, SIMBA will apply network management controls if your usage of mobile data, roaming or otherwise, as described above or otherwise, results in, may result in, or is reasonably likely to result in, network congestion, service degradation, without further notice or disproportionate consumption of shared resources. You acknowledge that traffic management measures may be applied at any time without further notice, including bandwidth shaping, throttling, de-prioritisation, or temporary or permanent restriction of service. Use of any SIMBA mobile services constitute acceptance of these measures under this fair use policy.
    18. For security, fraud-prevention, and customer verification purposes in accordance with IMDA's prescribed standards, any replacement of a SIM card or e-SIM that has already been activated requires the Customer to undergo in-person Know-Your-Customer (KYC) verification at a location designated by SIMBA. There are no exceptions to this requirement. The Subscriber acknowledges that a replacement SIM card will not be issued unless and until the Subscriber is successfully verified in person. Where the Customer is unable to attend in person, SIMBA may, at its sole discretion, offer an outcall verification service. Outcall verification is chargeable at SGD 50 or any other amount notified by the SIMBA from time to time, whichever is higher. SIMBA is under no obligation to provide outcall verification and may decline to do so.
    19. The following shall be applicable to SIMBA mobile plans that offer Rollover Entitlement, which shall mean any unused mobile data, roaming data, or IDD minutes at the end of a renewal cycle of your mobile plan, that may be carried forward in accordance with the conditions set out below.
      1. Rollover Entitlement will be rolled over to the immediately following or next renewal cycle for a maximum of six (6) renewal cycles.
      2. Such entitlements that are rolled over will be capped to six (6) months of the mobile plan's entitlement (base + prevailing promo).
      3. Rollover Entitlement is only valid when all renewal payments are paid on time. Otherwise, we reserve the right to forfeit all accumulated Rollover Entitlement.
      4. For avoidance of doubt, in the event that renewal payment is not made on time, but made subsequently, you acknowledge that as a result of your non-payment when payment was due, Simba has the right to forfeit all Rollover Entitlement accumulated to the point of non-payment.
      5. Rollover Entitlement will be forfeited when you request and/or complete a change of plan, request for a mobile number port to another mobile operator, and/or if your mobile plan is suspended in accordance with regulatory actions or in accordance with these terms and conditions herein.
      6. Unutilised Rollover Entitlement is not redeemable for cash or credit, and cannot be transferred to any other account (including other accounts under your name) or to any other person or party under any circumstances.
  9. Phone Numbers
    1. This section applies if you acquire a telephone or other service number.
      1. All phone numbers are selected, issued and used by us in accordance with the National Numbering Plan by IMDA.
      2. We may be required to recover and replace a phone number we have issued to you in order for us to comply with the numbering regulations. We will give you as much notice as is reasonably practicable if we have to do this.
      3. You may request for a new phone number. If we agree to issue to you a new phone number, you may have to pay a charge.
      4. If you need a new phone number because you have received calls of a harassing nature and you reported the matter to the relevant law enforcement agency, we will supply you with a new phone number free of charge on the first two occasions. You will have to pay a charge for any further phone number changes.
      5. You do not own the phone number but your right to use the phone number starts when we issue the phone number to you.
      6. Your right to use the phone number ends if the phone number is suspended in accordance to these Terms and Conditions, or if you no longer subscribe to the service, unless you apply to transfer the phone number to another service provider. You acknowledge that you are required to pay the activation fee stated in the CIS before you apply to transfer the phone number to another service provider within the first thirty (30) days of your subscription of a service to SIMBA; and this clause will suffice as any required advance notice to you of your breach of the agreement if you apply to transfer the phone number prior to such payment. Your service will be suspended immediately upon your application to transfer the phone number prior to the payment of the activation fee due to an express breach of this clause and the agreement.
    2. You may transfer your service number to another carrier or service provider. If you do so you acknowledge and understand that:
      1. charges may apply as a consequence of a transfer from us to another carrier or service provider;
      2. any outstanding fees and charges which remain your responsibility;
      3. the transfer may result in disconnection of any related services such as Voicemail and data services, silent numbers, priority assistance or other enhanced services;
      4. it is your responsibility to ensure that any equipment or software used by you in connection with your service works with your new carrier or service provider; and
      5. if after the transfer of your service from us, you continue to use our service (for example through the use of an override code), you agree to pay us for any fees and charges incurred for those services.
    3. In the event that you transfer from us prior to the expiration of the Minimum Contract Period applicable to your plan (if any), you will be liable for any outstanding fees and charges including plan pay out and plan cancellation fees.
    4. If you transfer your phone number from another carrier or service provider to SIMBA:
      1. you authorise us to sign on your behalf and in your name forms of authority to your current carrier or service provider to transfer your phone number(s) to us and you authorise your current carrier or service provider to transfer to us all services relating to the phone numbers transferred to us;
      2. if your current carrier or service provider charges or credits us with any amount concerning services provided before the date of transfer, we will credit or charge that amount to your account accordingly and as soon as practicable; and
      3. you indemnify us against any claims made by your current carrier or service provider to us in relation to any amounts owing by you to them.
      4. If you do not have an empty Postpaid card limit slot, SIMBA shall, at our discretion, provision the service onto any empty Prepaid card limit slot, and your registration of Simba’s mobile service is an agreement and acknowledgement of this.
    5. If you stop obtaining the service and do not port the phone number to another carrier or service provider, or your service is otherwise terminated, we may issue the phone number to another customer or to another carrier or service provider in accordance with the numbering regulations without further reference to you.
    6. We are not liable to you for any expense or loss incurred by you due to:
      1. any recovery or recovery and replacement of the phone number under clause 9, or
      2. you ceasing to have the right to use the phone number under clause 9.
    7. If your service is disconnected or transferred from us you must pay us all outstanding amounts under the agreement.
    8. Upon our approval of your application and allocation of the phone number to you, you must activate the phone number in accordance with this section, failing which you will cease to have the right to use the phone number and will not be entitled to any refund for your purchase of the phone number or the SIMBA service, and we will have the right to deal with the phone number as we deem appropriate (e.g. re-circulating such phone number to other customers)
      1. For eSIM new number requests, activation will occur upon SIMBA sending the QR Code to your provided email address; and for eSIM port-in number requests, activation will occur upon successful porting in (within 1-2 working days) and SIMBA sending the QR code to your provided email address.
      2. For walk-in collection of SIM card, your service shall be activated upon your collection; and you are obliged to collect your SIM card within 90 days of your application and allocation of a phone number.
      3. For postal mail collection, your service shall be activated upon your completion of the activation process as informed to you; and you are obliged to active your service within 14 days of your application and our allocation of the phone number to you.
    9. This section applies if you acquire a Lucky mobile number from SIMBA:
      1. Lucky mobile numbers are acquired at the point of registration of your SIMBA service, and will be subjected to the additional terms and conditions here.
      2. All Lucky mobile numbers are sold at a discount of 50% (unless otherwise specifically stated for special promotions), and the price that you pay is after the discount is applied. The discount is provided on the condition that you continue with a valid mobile plan with SIMBA for a period of 24 months from the activation of the Lucky mobile number). The discounted amount will be chargeable to you if you request for porting-out or your mobile plan is terminated for any reason whatsoever, before the expiry of the period of 24 months from the activation of the Lucky mobile number.
      3. Lucky mobile numbers may not be resold, assigned or transferred to any third party, except with SIMBA’s prior approval in writing, which shall be subject to SIMBA’s sole discretion.
    10. SIMBA reserves the right to terminate the service, and recover the phone number associated with that service, without advance notice to you, if we have, exercising our sole discretion, reason to believe that the phone number was acquired irregularly, fraudulently or otherwise in an unauthorized manner. For avoidance of doubt, your application to transfer any number acquired from SIMBA that was at any point deemed to be a Lucky mobile number without the payment of the remaining 50% price of such Lucky mobile number shall be deemed to be an act or attempt to defraud SIMBA; and any monies paid for that Lucky mobile number will not be refundable to you.
  10. IP Addresses
    1. You agree that the IP Address(es) issued to you for use in connection with a service are only issued to you for use during the term of your acquisition of the service. On termination of the service, your right to use the IP Address(es) ceases.
    2. We are responsible for all DNS delegation and routing in connection with the service.
  11. Billing and account payment
    1. We will send you the bills through the SIMBA My Account website or to your email address at 30 days intervals. However, we may change our billing cycle and send you bills at intervals and on dates as we decide or in accordance with your mobile plan. Please note that your initial recurring bills may be issued at a point later than 30 days, in the intervening period you are responsible for paying all charges as applicable according to your mobile plan.
    2. You agree to notify us in writing of any error in the bill within 14 days from the date of the relevant invoice. If you do not do so, the fees or charges in the bill shall be conclusive and binding on you.
    3. If you choose to dispute any fees or charges which you have paid, you have three (3) months to do so from the date of the relevant invoice or the date on which the Charges were deducted or paid. Charges that are not disputed within three (3) months of its issuance shall be deemed to be accepted by you, and you agree to waive all rights, to the extent allowed by law, to challenge and/or dispute the bill in any manner whatsoever.
    4. Usage records and download times can vary from time to time. Whilst we aim to do so, we are unable to guarantee that all usage records during a billing period will appear on the corresponding bill. This is particularly so for charges incurred whilst using international roaming but also applies for other types of usage.
    5. Payments may be made to us through our available payment methods. Service fees and charges may apply for some available payment methods. We will apply payments made by you against outstanding tax invoices at our discretion.
    6. If you have chosen to use our direct debit facilities, and we have not received your payment by the due date, unless we agree with you otherwise, we will debit your nominated account on or after the due date. We may continue to do so at any time until all amounts due are paid. We will provide SMS or email notification when debits are made.
    7. Where in our opinion you have a reasonable claim or dispute with an invoice or a debit, we will suspend our collection or recovery processes until a determination on your claim or dispute has been made. Your notice of dispute to us should clearly state the reason of disputing the relevant charges and the amount in dispute.
    8. We will conduct a complete and objective review of such dispute and shall respond to you in writing within (30) days from the date we receive your notification of dispute.
    9. Other than the amounts disputed, you are responsible for making payments of the undisputed Charges by the due date without any deduction, withholding or setoff.
    10. In the event both parties are not able to resolve any dispute, they may (a) refer the matter under IMDA’s Alternative Dispute Resolution Scheme, if it is within the ambit of the scheme; (b) refer the matter to the Small Claims Tribunal (SCT), if the matter is within the SCT’s jurisdiction; or (c) if the matter falls outside the ambit of the ADR Scheme and SCT’s jurisdiction, submit the dispute to any courts of Singapore.
    11. All administration, registration and set-up fees are non-refundable.
    12. Accepted credit cards: Visa and Mastercard. We do not accept virtual and prepaid credit cards.
    13. You are responsible for ensuring there is sufficient funds/credit available in your nominated credit card or direct debit account at any time we debit the account. You must pay dishonour fees and any other charges, expenses or losses resulting from our attempting unsuccessfully to debit the credit card or direct debit account unless the failure was due to a clear error on our part. Dishonoured cheques incur a $10.00 inc GST handling charge.
    14. You are required to inform us if your credit card is due to expire at least two weeks prior to the expiry date and are required to provide us with details of a current credit card. You must also advise us if your nominated direct debit account is transferred or closed, or the account details have changed.
    15. Where you provide a credit card number or re-advise a credit card number for the purpose of setting up an automatic recurring payment with SIMBA, SIMBA will immediately debit the credit card for any outstanding amount owing or an amount of $1 if there is no current amount owing without further reference to you. Any debit of $1 is to confirm with your financial institution that the card number and CVC are correct and shall be credited back to your account. The CVC is not retained by SIMBA. Thereinafter, you authorise SIMBA and the financial institution to charge an amount necessary for the continuation of your mobile plan for SIMBA's Services under this Agreement or as agreed by you, save for if you terminate the mobile plan in accordance with this Agreement. Your election to input your credit card details is automatically deemed to be your express consent to opt for automatic recurring payment for your mobile plan, and authorisation for SIMBA to charge to your credit card any monies payable for the next billing period. Such authorisation and standing instruction will remain effective and unchanged unless you request to deactivate or cancel your standing instructions for automatic recurring payment in the manner which SIMBA prescribes, and such cancellation is accepted by SIMBA. For avoidance of doubt, such cancellation shall only be effective upon SIMBA's confirmation of acceptance, and any payments prior to such confirmation by SIMBA shall proceed unaffected, be deemed accepted and irrevocable by you.
    16. SIMBA will not accept Prepaid Visa/Master credit cards or gift cards.
    17. If you have failed to pay to SIMBA an amount which is due, we may follow appropriate notice to you refer the debt to a third-party collections agent for the purpose of collection activity. You must pay all costs, charges and expenses that we may incur in relation to our attempts to recover all debts due by you to us, including accounting, mercantile agents cost and interest.
    18. SIMBA may apply a credit limit for Charges under your account and/or require you to make payments in advance of your next bill in case of any high or unusual usage by as reasonably determined by us. Services may be suspended in case of non-payment of such amounts and or if the credit limit is exceeded.
    19. If, as a result of participating in any promotions by SIMBA, you receive any SIMBA promotional credits in your SIMBA wallet, you agree and acknowledge that any monies in your SIMBA wallet shall be utilised in precedence to any SIMBA promotional credits. This arrangement shall apply absolutely regardless of whether your cash top up to your SIMBA wallet was completed before or after the crediting of the SIMBA promotional credits into your SIMBA wallet.
  12. Bank account direct debit (GIRO) terms
    1. If you have arranged to pay us by providing a Direct Debit Request via General Interbanking Recurring Order (GIRO) ("Your Direct Debit Request"), this clause sets out the terms on which we accept and act to debit amounts from your account under the Direct Debit System.
    2. We agree to be bound by this clause when we receive your Direct Debit GIRO Request complete with the particulars, we need to draw an amount under it.
    3. We may have requested from you an online or verbal declaration giving us authority to deduct monies from your bank account. By agreeing to this declaration, you will be regarded as having 'signed' a Direct Debit GIRO Request (DDR) Form. You must notify your bank and us if you intend to terminate payment via GIRO. You also agree that we may reproduce the document from our electronic records and that the reproduced document shall, in the absence of error, be an accurate copy of this document signed by you.
    4. If you are not authorised to operate this bank account by yourself then those people(s) whose authority is required must complete and sign a DDR and return it to us.
    5. As recipient of a Direct Debit Facility via GIRO from you, we will:
      1. provide you with a statement of the amounts we draw under your Direct Debit Request every 30 days as per clause 10.1;
      2. agree to deal with any dispute raised under your Direct Debit Request as follows: We will investigate the dispute and if it is found that the amount has been debited in error we will refund the disputed amount within 5 business days. Where it is found that the disputed amount has been debited correctly and in accordance to the terms of the Direct Debit Agreement, we will notify you of that outcome in writing within 5 business days; and
      3. not disclose any personal data provided to us under the Direct Debit Request, which is not generally available, unless: you dispute any amount we draw under your Direct Debit Request and we need to disclose any information relating to your Direct Debit Request or to any amount we draw under it to the Financial Institution at which your account is held or the Financial Institution which sponsors our use of the Direct Debit System or both of them; you consent to that disclosure; or we are required to disclose that information by law.
    6. As the Provider of Your Direct Debit Request, you:
      1. authorise us to draw money from your account in accordance with the terms of your Direct Debit Request and the agreement;
      2. acknowledge that if the day on which you are due to make payment to us is not a business day, we draw under your Direct Debit Request on the next business day following the normal payment date. You will need to enquire directly with your financial institution if you are uncertain when they will process an amount, we draw under your Direct Debit Request on a day that is not a business day;
      3. may ask us to:
        1. alter the terms of your Direct Debit Request;
        2. defer a payment to be made under your Direct Debit Request;
        3. stop a drawing under your Direct Debit Request. In such instances an alternative method of payment must be arranged 3 days prior to the due date and payment received by the due date; or
        4. may cancel all your services including your Direct Debit Request by sending a written request including your customer number and telephone number to us;
      4. will advise us of any disputed amount drawn under your Direct Debit Request as soon as practically possible by notifying us of your dispute by letter or email (include your customer number and telephone number to us) and provide us with details of the payments in dispute and reasons for the dispute. We will endeavour to resolve any dispute within 21 days. Disputes may also be directed to your own Financial Institution;
      5. acknowledge it is your responsibility to ensure there are sufficient clear funds available in your account by the due date, on which we will draw any amount under your Direct Debit Request, to enable us to obtain payment in accordance with your Direct Debit Request;
      6. acknowledge that if your Financial Institution rejects any of our attempts to draw an amount in accordance with your Direct Debit Request, we will recharge any dishonour fees charged to us by the Financial Institution, to your account. We will make two attempts to draw outstanding amounts in accordance with your Direct Debit Request. If these fail, we will contact you by telephone or in writing to seek alternative methods of payment for the outstanding balance of your account, and to agree a suitable payment method for future account payments;
      7. acknowledge not all accounts held with a financial institution are available to be drawn under the Direct Debit System and that prior to providing your account details to us under the Direct Debit Request, have verified those details against a recent statement from your Financial Institution to ensure those details are correct.
  13. Suspension/Termination of the service
    1. If you fail to comply with any of the following or any other term or condition of this agreement we will provide you with notice of your failure and allow you a reasonable time to remedy it, failing which we may suspend (or such period as SIMBA may consider appropriate) or terminate your service :
      1. you have not paid charges when due and have not remedied that failure within what we consider to be a reasonable time;
      2. you are no longer approved under our assessment policies or otherwise to receive the service;
      3. you vacate the premises in which you are provided the service without notifying us beforehand and fail to provide us with the new address within reasonable period;
      4. we are entitled to do so under the specific terms and conditions of your plan or package;
      5. you threatened, insulted, verbally abuse, attempt or threaten to cause harm to any of our staff or damage to our property, ; or
      6. you are in breach of any provision in these Standard Terms and Conditions, especially clause 8.
    2. We may suspend or terminate your service without notice in any of the following situation:
      1. you have created, or is likely to create, imminent physical harm (such as interruption, disruption or congestion) to our network;
      2. you have committed, attempt to commit, or suspected to have committed, fraud against us, including offering or giving any gift or consideration of any kind to any officer, employee, agent or contractor of SIMBA as an inducement or reward in connection with the provision of any service or equipment;
      3. we are acting in compliance, or to comply, with the requirement of any relevant regulatory authority or law enforcement body;
      4. if you pass away or becomes incompetent to contract by reason of mental incapacity (if you are an individual);
      5. if you cease to carry on business or otherwise ceases to exist (if you are a corporate entity);
      6. you have misused, attempt to misuse, or suspected to have misused, any of our IT systems or telecommunications network, or the associated physical or virtual infrastructure whatsoever.
    3. In the event that you make a request to terminate your mobile plan either (i) during the processing of the fees and charges for the next billing period, and/or (ii) where such request results in your incurrence of any liability to SIMBA for the payment of any monies pursuant to any contractual agreement entered by you, you agree and acknowledge that your mobile plan and/or agreement shall retroactively be deemed to be suspended from the period beginning three (3) days prior to your request under this clause 13.3, always notwithstanding that such suspension shall or shall not result in your actual and/or continued use of SIMBA's service on a regular or reduced basis. Such suspension under this clause 13.3 shall only be removed when you make the outstanding payment due to SIMBA in full, and/or are otherwise not liable to SIMBA for any outstanding monies.
    4. Where one or more services included in a bundled offer(s) are disconnected, entitlement to any discounts under such offers may be forfeited.
    5. While your service is suspended or disconnected, we will continue to charge you any applicable fees and charges. We will only do so where the suspension or disconnection is due to your failure to comply with your obligations under this agreement, or is performed at your request.
    6. Where we disconnect your service prior to the expiration of the Minimum Contract Period of your plan you will be liable for any outstanding fees and charges, including the remaining access fees on your plan plus a plan cancellation fee if applicable. We will only charge a plan cancellation fee in circumstances where you have failed to comply with an important term or condition of our agreement.
    7. We are not liable to you or any person(s) claiming through you for any loss or damage arising from suspension or termination of your service in accordance with this clause. Credits in the Main Wallet shall not be refundable to or exchangeable for cash (please refer to the relevant CIS applicable).
    8. The suspension or termination of any service shall be without prejudice to any other right which SIMBA may have whether under this Agreement or otherwise.
    9. SIMBA may, at its absolute discretion and subject to any customer agreement relating thereto and any other terms which SIMBA may impose, including without limitation payment of admin fees, reinstate any service which has been suspended or terminated subject always to the terms of the customer agreement thereto.
    10. The rights conferred on SIMBA to terminate or suspend any service shall be exercised subject to such restrictions, limitations and prohibitions imposed by regulatory authorities including IMDA.
    11. Termination Request Process
      1. For termination of the SIMBA services, please submit an Account Termination Form.
      2. We will acknowledge your request within 2 business days and process it within 7 business days if there are no outstanding dues.
      3. In exceptional cases requiring more than 7 business days, we will advise on the timeframe and the reason(s) requiring more time.
      4. We will not charge you for the next 30-day cycle if the termination request is submitted at least 7 business days before the renewal of the next 30-day cycle.
  14. Force Majeure
    1. We will not be liable for:
      1. any delay in installing any service.
      2. any delay in correcting any fault in any service.
      3. failure or incorrect operation of any service, or
      4. any other delay or default in performance under this Agreement.

      If it is caused by any event or circumstance reasonably beyond our control, including but not limited to; war, accident, civil commotion, riot, military action, sabotage, act of terrorism, vandalism, embargo, judicial action, labour dispute, an act of a government or a government authority, acts of God, earthquake, fire, flood, plague or other natural calamity, computer viruses, hacker attacks or failure of the internet or delay, or failure or default by any other supplier.

  15. Limitation of Liability
    1. You must let us know as soon as you become aware or believe that you have a claim against us.
    2. We are not liable for any defamatory, offensive or illegal conduct or material found in connection with our services, including such conduct or material transmitted by any means by any other person.
    3. You indemnify us from and against all actions, claims, suits, demands, liabilities, losses, costs and expenses arising out of or in any way connected with your use, or the use of any user which you knowingly permitted, or the use of any user whose use you had unknowingly or negligently omitted to deny the use of, of the service or the equipment in a manner contrary to the terms of this agreement.
    4. Where you are two or more persons your liability will be joint and several.
    5. To the fullest extent permissible under Applicable Laws, SIMBA shall not be liable in any way to you whether in equity, contract, tort (including negligence, breach of statutory duty, or breach of regulatory duty) or otherwise for any direct or indirect loss or damage (including loss of revenue, or profits, or any monies that are not controlled or known of by SIMBA) howsoever caused, including but not limited to any such loss caused or arising from any breach or failure by SIMBA to perform any of its obligations under any agreement or any regulation or regulatory direction.
    6. Accessibility to our roaming services is dependent on our overseas partners’ network coverage and technology. We do not guarantee and shall not be liable for the availability, coverage, speed and signal strength of our overseas partners’ network. You agree and acknowledge that your mobile device settings may cause you to automatically roam between different partner networks within our network area and roaming coverage areas. You further agree and acknowledge that certain services or features may not be available in roaming coverage areas, and call quality may be lower while roaming.
    7. Notwithstanding the above and subject to the above exemptions and exclusions SIMBA cumulative liability to you whether in contract, tort (including negligence or breach of statutory duty) or otherwise for any and all losses, damages or liabilities arising from any breach, failure, default to perform any of the obligations by SIMBA to you shall not in aggregate exceed the amount equal to S$5000 or 3 months’ charges preceding the event or series of event, whichever is lower.
    8. The Customer expressly agrees that the SIMBA, without prior notice, deduct or set off any amount owing to SIMBA under this indemnity from the Customer’s wallet balance or any other credits held in the Customer’s account. Any such deduction shall not limit or prejudice SIMBA's right to recover amounts exceeding the available wallet balance through other means, nor shall it constitute a waiver of any other rights or remedies under these terms or at law.
  16. Assignment
    1. You may not assign or transfer your rights and obligations under this agreement unless approved by us. SIMBA excludes all liability whatsoever arising from the use of the services by a user whose use of your rights and obligations were not approved by us, and you agree to indemnify us in accordance with clause 15.2 herein.
    2. Where we reasonably consider there will be no detriment to you, we can without your permission and without notice:
      1. transfer our rights and obligations under this agreement to a third party;
      2. temporarily or permanently delegate our obligations under this agreement to the third party; or
      3. novate this agreement to the third party by ending this agreement and entering into a new agreement between you and the third party, on terms similar to this agreement.
    3. If we do any of the above the transfer or delegation or novation will take effect when the relevant document is signed. You irrevocably appoint us as your attorney to sign any necessary documents to enable the transfer, delegation or novation to take effect.
  17. Governing law
    1. This agreement shall be governed by the laws of Singapore. You and we agree to submit to the exclusive jurisdiction of the courts of Singapore. However, if required SIMBA may initiate proceedings in any jurisdiction as it may deem necessary.
    2. Without prejudice to SIMBA’s right to serve process in any other manner permitted by law, SIMBA may effect service on you of any writ, summons or other process or documents by leaving it at or sending it by ordinary post to your last known address (whether to a post office box or to a place of residence or business or otherwise). Such process shall be deemed validly served on you:
      1. in the case of service by leaving it at your address, immediately; and
      2. in the case of service by post,
        1. to any address in Singapore, two (2) days after it was posted by the Service Provider; or
        2. to any address outside Singapore, fourteen (14) days after it was posted by the Service Provider.
      and you agree that it shall be deemed that you shall have adequate and sufficient notice of such process.
  18. Meaning of words
    1. Terms used within this agreement have the following meaning unless the context suggests otherwise.
      1. "agreement" means the agreement for the provision of the services between us comprising the items outlined in clause 1.2 of these Standard Terms and Conditions.
      2. "billing period" means the period in which you are billed by us for service.
      3. "carrier" means a Telecommunications carrier licensed under the Telecommunications Act (Cap 323).
      4. "credit assessment criteria" means those criteria we use to determine whether we wish to accept or decline to provide or continue to provide you with the service. These criteria may change from time to time without notice to you, for example you must: be alive; not be insolvent or bankrupt or subject to any proceedings to make you insolvent or bankrupt; where you are in a partnership, the partnership must not have been dissolved; where you are a company neither you nor any of your assets may have been assumed under the terms of a debt security instrument or under court order or otherwise appointed.
      5. "credit limit" means a limit we may place on your use of a service or on amounts you owe us at a point in time.
      6. "current supplier" means a carrier or telecommunications service provider who supplied telecommunications to you at the time of signing the agreement.
      7. "Direct Debit Facility" means the debit account or credit/charge account nominated by you for the debiting of your fees and charges.
      8. "due date" means the date the amount shown on your tax invoice is due to be paid to us. The due date is not less than 14 days after the tax invoice date.
      9. "enhanced services" means the services we provide that are designated by us as enhanced services. Our website and plan brochures will detail which services we have designated as enhanced services.
      10. "equipment" means the item(s) required or otherwise used in conjunction with your service such as mobile phones, fixed lines phones, personal computers, software and modems purchased from us or otherwise.
      11. "fees and charges" means fees and charges payable by you under your plan and under this agreement including any amounts of applicable GST.
      12. "fixed line service" means the standard telephone service comprising connection to the public switched telephone network plus any other service(s) offered by us including any enhanced services.
      13. "fixed period contracts" are contracts you entered into with us where you commit to a minimum period for which you will acquire the service and may be set out in the agreement, but do not include month to month contracts.
      14. "GST" means the tax imposed by the GST Act and the related imposition Acts on the supply of goods and services in Singapore and the importation of goods into Singapore.
      15. "GST Act" means the Goods and Services Tax Act 1993 of Singapore, as amended from time to time
      16. "internet service" means connection to the global network of computers known as the internet using software protocols supported by us, plus any other services offered by us including enhanced services.
      17. "IMDA" means the Info-communication Media Development Authority.
      18. "mobile network" means the mobile network over which we supply the service.
      19. "mobile service" means the connection to the mobile network plus any other services offered by us including enhanced services.
      20. "package" means a grouping of services and plans, which are sold together under specific terms and conditions.
      21. "passwords" means the personal or security codes such as your customer service account passcode or website password used by us to confirm that an individual has authority to enquire or transact on your account.
      22. "personal data" has the same meaning as defined within the Personal Data Protection Act 2012.
      23. "plan" or "mobile plan" means your plan for each of the service(s), the terms and conditions of which may include a minimum term, monthly fees and call charges as amended from time to time.
      24. "plan brochure" is any brochure or other document (including a webpage) which sets out the terms and conditions of a plan.
      25. "premium services" means content or information services, charged at a flat or timed rate, such as picture, ringtone and game downloads, and SMS messages to weather services, as well as psychic, voting and competition lines. Premium Service phone numbers usually begin with 1900 or an international prefix.
      26. "primary contact" means the mobile or fixed line service number, email address or other specific contact designated by you and accepted by us to use as our primary means of contacting you in relation to your account.
      27. "priority assistance" means services offered to persons who are diagnosed with a life threatening medical condition with a high risk of rapid deterioration to a life threatening situation and where access to a telephone would assist to remedy the life-threatening situation.
      28. "service" means any and all of the digital mobile phone services, fixed line services and internet services that we provide to you including any enhanced services and also includes our customer support services. Information on our services is available on our website.
      29. "service network" means the carrier of the telecommunications services sold to you by us and includes the mobile network.
      30. "SIM card" means the subscriber identity module card, which the network owns, but is provided to you to be placed into your mobile phone to enable you to access your mobile service.
      31. "third party content" means products and information provided by third parties to you, which you can access through your service.
      32. "third party content supplier" means a party that provides third party content to you through the service.
      33. "transfer" means to port, move or swap your service number from one carrier or service provider to another as defined and required by IMDA.
      34. "usage record" means the record of a call or data transfer provided to us by the service network.
      35. "user" means someone who uses a service, which may or may not be the account holder.
      36. "We, our, us" refers to SIMBA Telecom Pte Ltd (UEN. 201617990D) which enters into the agreement with you, or any of our related corporations (as described in Section 6 of the Companies Act 1967).
      37. “You” means the user who enters into an agreement with us to subscribe to our mobile plan and/or service and are who are bound to these Terms and Conditions as a result of their subscription or use of the service.

  1. Eligibility
    1. This promotion is open to all active SIMBA subscribers.
    2. To qualify, subscribers must top up a minimum of SGD 199 in a single transaction during the promotion period, at one of the participating locations.
    3. The promotion is limited to one (1) redemption per MSISDN, tied to each individual subscriber’s identity number..
  2. Promotion Period
    1. The promotion commences on 4 May 2025 and shall remain valid until stocks of the promotional phone is unavailable.
    2. SIMBA reserves the right to amend or terminate the promotion without prior notice.
    3. The promotion will cease immediately upon the giveaway of the SHARP phone, regardless of top-up activity thereafter.
  3. Promotion Details

  4. Stock Availability

  5. Non-Exchangeable & Non-Transferable

    2. This promotion is non-transferable and may not be combined with other ongoing offers unless expressly stated.
    3. All top-ups of SGD 199.00 made under this promotion are strictly non-refundable and non-transferable.
  6. Fraud Prevention
    1. SIMBA reserves the right to cancel any redemptions and/or suspend accounts where abuse is suspected, including but not limited to, use of multiple identities to gain multiple entitlements.
    2. SIMBA may recover the retail value of the phone or take other legal action in such cases.
  7. General
    1. SIMBA reserves the right to vary these Promotional Terms & Conditions or withdraw the promotion at its sole discretion.
    2. Participation in the promotion constitutes acceptance of these terms.
    3. These terms are governed by the laws of the Republic of Singapore, and any disputes shall be subject to the exclusive jurisdiction of the Singapore courts.
